Terms of Sale

  1. This is a catalogued auction, and unless otherwise announced by the auctioneer all items will be offered per numbered lot as they are listed in the catalog. An estimated price for each lot is offered in bold type and is to be used as a guideline only as they do not necessarily reflect actual values. Condition grading is offered only as a convenience to customers.
  2. Hunt Auctions guarantees, for sixty (60) days, the authenticity of each item offered at auction as set out in the written description listed in the printed and/or online catalogue. All announcements posted online and/or made by the auctioneer the day of the auction shall take precedent over previous statements either implied or written. The guarantee does not extend to descriptions of lot condition due to the subjective nature of such evaluations. With regard to autographed materials, we strongly encourage interested bidders to utilize the photographs available in the printed and online catalogue to consult with autograph experts of their choice before bidding. To be able to make an authenticity claim under this guarantee, the original purchaser of record must: 1) notify Hunt Auctions of a dispute within sixty days of the close of the auction; 2) provide a written letter of rejection by an independent and recognized expert in the field; and 3) return the lot to Hunt Auctions in the same condition as it was on the date of the auction. If necessary, Hunt Auctions reserves the right to consult with another respected third party authenticator to settle the dispute. The guarantee is solely for the benefit of the original purchaser of record from the auction and may not be transferred to any third party.
  3. A premium of seventeen and a half (17.5%) percent will be added to the successful bid price and is payable by the purchaser as part of the total purchase price.
  4. The highest bidder acknowledged by the auctioneer will be the purchaser. In the event of any dispute among bidders, or any other issue with respect to the highest bid or the validity of a bid, Hunt Auctions has the final discretion and may reoffer and resell any lots or take whatever actions they deem necessary to settle said dispute. In the event of any dispute after the sale Hunt Auctions record of final sale shall be conclusive.
  5. The auctioneer reserves the right to reject any bid or raise which, in the auctioneer’s opinion, is not commensurate with the value of the lot being offered or which may have a detrimental effect on the lot in question or the auction as a whole. Reserve bids may be executed on catalogued lots on behalf of the seller and shall be executed confidentially in a manner similar to the execution of absentee bids.
  6. Hunt Auctions reserves the right to withdraw any lot at any time prior to the auction and assumes no liability for such withdrawal.
  7. Absentee and phone bids will be executed as a convenience to customers, but the auction company will not be held responsible for any failures, or errors or omissions in the execution of such bids. All absentee or phone bids must be submitted within the guidelines of this auction.
  8. Title of each lot passes when the auctioneer says “SOLD.” There-after any loss by fire, theft, breakage or any other cause is the sole responsibility of the purchaser. If Hunt Auctions packs or transports the lot, or any portion thereof, it is fully at the risk and responsibility of the purchaser and Hunt Auctions shall not be liable for any loss or damage that they, or any of their employees, may cause.
  9. Unless exempted by law, the purchaser will be required to pay Pennsylvania sales (6%) tax or any applicable compensating use tax on the total purchase price. Deliveries outside the state may be subject to the compensating sales or use tax of another state. Where duty or collection is imposed on Hunt Auctions by law, it will require payment of these taxes.   10. Payment is due immediately upon receipt of invoice in the form of cash, bank/cashier’s check, money order, personal check, Zelle (payment@huntauctions.com) wire transfer (Any wire less than $500 is subject to a $15 fee; all foreign wires please add $20), ACH transfer or certified funds in USD ONLY. No credit cards or PayPal will be accepted. All items purchased must be paid for in full before items are released to the purchaser. Hunt Auctions reserves the right to hold merchandise until payment is qualified. Hunt Auctions reserves the right to collect unpaid past due invoices in any manner whatsoever including, but not limited to, charging the bidder’s credit card on file. Any bidder with an outstanding invoice beyond 30 days will have future bidding privileges suspended. At this point, we will charge your credit card for the balance due, plus assess a $25 late fee. Reinstatement will be solely at the discretion of Hunt Auctions. Should legal action be required to collect unpaid balances, the bidder will be responsible for related attorney’s fees, court costs and costs of collection. In addition, Hunt Auctions reserves the right to re-sell the merchandise of any bidder whose balance due is unpaid after (45) days with the bidder responsible for payment of the difference between the amount of the original bid placed by the bidder plus the premium of seventeen and a half percent (17.5%) and the actual amount received by Hunt Auctions for each item, together with any and all attorney’s fees, court costs and costs of collection.
  11. Placing a bid constitutes acceptance of all terms and conditions contained in these Terms of Sale. The validity, construction, enforcement and interpretation of all terms and conditions contained in these Terms of Sale shall be governed by the internal law (and not the law of conflicts) of the Commonwealth of Pennsylvania. By submitting a bid, bidder consents that any legal proceeding involving any matter relating, directly or indirectly, to these Terms of Sale shall be commenced and maintained in the Federal Court located in the Eastern District of Pennsylvania or the Court of Common Pleas of Chester County, Commonwealth of Pennsylvania. Each term and provision of these Terms of Sale shall be construed as separate and distinct. If any term or provision contained in these Terms of Sale is held to be invalid under present or future laws, the legality, validity and enforceability of the remaining provisions shall not in any way be affected or impaired.

Provenance: Origins of a particular item such as the personal collection of a player.
Professional model: Item such as jersey, bat, or helmet manufactured specifically for game use by a professional player.
Attributed: Descriptive term referencing, among other things, the origins of a particular item or likely use in game action. For example, “Babe Ruth professional model bat attributed to his 50th home run.”
Replica: Item reproduced at a later date than its original. For example, “1980 Philadelphia Phillies replica World Series trophy”.
Salesman Sample: Item produced for marketing use by a salesman of the particular product such as a ring or baseball bat.
Game Used: Item which has been fully authenticated to have been used by a player during game action.

Bidding Instructions

IN PERSON LIVE BIDDING (If applicable)

Bidders participating live and in person may register upon arrival. Items may be paid for and removed at any time during the event. If not already on file, tax exempt bidders must provide a valid resale certificate upon registration. Non tax exempt bidders who remove items onsite will be subject to applicable sales tax regardless of their state of residence. All items must be paid for in full by cash, traveler’s checks or certified funds before being removed by the purchaser. Those who wish to pay with non-guaranteed funds (personal or business check) must provide a letter of credit from their bank prior to the auction. Bidders known to Hunt Auctions may pay with a personal check and remove merchandise at the discretion of Hunt Auctions. Any items not removed from the auction site will be returned to the Pennsylvania office of Hunt Auctions for shipment.

ABSENTEE BIDDING

Bidders not attending the auction may choose to place ceiling or max bids to be executed by Hunt Auctions. All bids are executed competitively against other live and absentee bidders and are bid with the intention of securing the lot at the lowest possible amount up to and including the bid amount. For example, if you leave a $1,000.00 bid on a lot and the lot brings $425 at auction, you will be the winning bidder at $425. If several absentee bids are left on a particular lot, the auctioneer will open the bidding one increment above the second highest ceiling bid. For example, if the highest bid left is $500, and the second highest $100, the bidding will open at $125.00.

Bidding increments are ultimately at the discretion of the auctioneer. All bids are rounded to the nearest dollar amount during the live auction. In most cases bidding will fall on $25.00, $50.00, or $100.00 increments. Hunt Auctions will not be responsible for any discrepancies regarding odd increment bids (i.e. $127.35 bid that sell for $125.00 to another bidder). In the case of tie absentee bids, the first bid placed will be given priority. Lots open at one increment above the second highest ceiling bid, and not at the high bid. Therefore, it is rare, but possible for a live bidder to win a lot for an amount equal to an absentee bidder’s left bid. Due to the nature of incremental bidding, Hunt Auctions will not be held responsible for this occurrence.

Hunt Auctions offers 4 methods of absentee bidding for this sale:

1. Telephone Bidding

Bidders may participate live over the telephone during the auction with a Hunt Auctions representative. Please contact Hunt Auctions at 610.524.0822 or by email at info@huntauctions.com to provide a list of applicable lot numbers and up to two telephone numbers where you can be reached for bidding. With regard to timing, the auctioneer will sell approximately 75 lots per hour. Hunt Auctions cannot guarantee the availability of phone lines for reservations made after Wednesday, May 1st at 5:00pm ET.

2. Traditional Absentee/Proxy Bidding

Bidders may submit absentee/proxy bids by phone at 610.524.0822 email at info@huntauctions.com, or by mail using the absentee bidding form provided in the back of this catalogue. Proxy bids will be entered on the bidder’s behalf into the online pre-bidding system (see #3 below) for competitive bidding until Wednesday, May 1st at 10:00pm ET. Bids placed after this point up until the start of the Live Auction will be executed competitively during the live auction against the highest online proxy bids, phone bidders, and in-person participants. Although we will do our best to get every bid in, Hunt Auctions cannot guarantee the execution of absentee bids placed after the close of the pre-bidding period.

3. Online Pre-Bidding until Wednesday, May 1st at 10:00pm ET

Bidders may participate in online pre-bidding at www.huntauctions.com until Wednesday, May 15th at 10:00pm ET. In order to take advantage of this option, you must first register to receive a user id name and password (bidders with pre-existing accounts may use their current usernames & passwords). Once you have completed the login procedure, you may browse and bid accordingly. Once logged in, the “Register/Login” button will switch to “My Account,” where you may view a status report of the items you are currently bidding on.

When advancing to the next bid, bidders will be required to bid 10% above the current high bid showing. Maximum/ceiling bids may be placed at any time and for any amount as long as they are at least 10% above the current high bid. Please note, during the course of incremental online pre-bidding, the system will automatically make a ceiling bid the high bid even if the ceiling bid is less than 10% than the last bid placed. An online ceiling bid only has to be 10% above the current high bid showing in order to be accepted and executed. All ceiling bids are held in strict confidence. Once entered into the auction database, ceiling bids are advanced automatically by the auction software with the intention of securing the item at the lowest possible price up to and not exceeding the ceiling amount. It is not possible to withdraw a current high bid; however, ceiling bids may be lowered to the current high bid at any time prior to the start of the Live Auction.

All lots will be listed with starting bids, which do not necessarily reflect published estimates or reserve amounts. Proxy bids placed via phone, email, or mail (see #2 above) will be entered into the online pre-bidding system along with any applicable reserve amounts so that online bidders will be able to see the current high bid at any given time. Online pre-bidding will cease Wednesday, May 1st at 10:00pm ET.

High Bids & Ceiling Bids placed during the pre-bidding period will be executed competitively during the Live Auction against other absentee bids, phone bidders, and in-person participants. All bidders are welcome to advance their absentee bids or register for phone bidding up until the Live Auction start; however, Hunt Auctions cannot guarantee the execution of absentee bids or the availability of phone lines for requests made after the close of the pre-bidding period.

4. Interactive Online Bidding

Interactive live online bidding is available to all registered Hunt Auctions bidders. The interactive bidding will be powered by Invaluable and may be accessed directly on our website at www.huntauctions.com. Bidders must have a valid Hunt Auctions username and email on file to bid interactively online during the live auction. Please note, unless you have already received premiere bidding status and plan to bid live online for item(s) totaling $20,000 or higher, you will need to be pre-approved as such. BID INCREMENTS

Bidding increments during the Live Auction are at the discretion of the auctioneer. Opening bids the day of the auction will be determined based on the absentee bids received prior to the sale (see section on absentee bidding). As a general guideline, bidding will occur in increments of approximately 10%.

LOT QUESTIONS

All absentee/phone bidders are strongly encouraged to solicit further information about specific lots before bidding. Hunt Auctions representatives are available to answer questions over the telephone and by email until Wednesday, May 1st at 5pm ET. Additional images may be provided upon request via mail and email. While we guarantee the authenticity of each item for sixty (60) days, we will not accept returns based on condition due to the subjective nature of such evaluations. Any questions or concerns regarding the condition of specific lots must be addressed prior to the sale.

SHIPPING

All remaining lots will be removed from the auction and returned to the Pennsylvania offices of Hunt Auctions for shipment or pick-up. Shipping, handling, and insurance for all absentee bid/phone items are the responsibility of the winning bidder. Items are packaged and shipped via Fed-Ex with a signature required. Shipment will occur 7-12 days after funds have been received and cleared. Shipping estimates may be provided upon request before the auction.
